JURISDICTION IN CASES OF MULTIPLE CRIMINAL OFFENSES

 

Jurisdiction based on the connection between criminal proceedings shall not apply if the repetition or accumulation of criminal offenses is discovered not during the pre-trial investigation, but before it begins. In this case, the qualification formula may include criminal offenses that, according to the rules of personal or subject jurisdiction, must be investigated by different authorities. It is proposed to combine powers of jurisdiction by creating interagency investigative teams.

IMPLEMENTATION OF EUROPEAN STANDARDS

IN THE FIGHT AGAINST CYBERCRIME:

PROBLEMS OF LEGAL REGULATION OF ELECTRONIC EVIDENCE IN UKRAINE

The article analyzes the need to harmonize Ukrainian legislation with European standards in the fight against cybercrime, with an emphasis on the implementation of the provisions of the Convention on Cybercrime and its Second Additional Protocol. It emphasizes the importance of introducing clear procedures for processing electronic evidence and harmonizing Ukrainian legislation with the EU Regulation on electronic evidence.

EFFECTIVENESS OF FINANCIAL MONITORING

IN THE CONTEXT OF ENSURING NATIONAL SECURITY: CONCEPT AND BASIC CRITERIA

 

The author's vision of the term “effectiveness of financial monitoring” as the ability of the financial monitoring system to timely and effectively detect, prevent, and counteract financial crimes by analyzing financial transactions, monitoring compliance with legal requirements, and coordinating the activities of financial monitoring entities. The criteria for the effectiveness of financial monitoring have been classified by specifying indicators of effectiveness, expediency, and efficiency. A definition of the concept of “criteria for the effectiveness of financial monitoring” has been formulated.

EU CRIMINAL LAW POLICY

The article highlights the relevance of terrorism as a global challenge that requires a comprehensive response from the EU. The author examines the EU's criminal law policy in the field of counter-terrorism, focusing on its legislative, institutional, and practical aspects.

It reveals the legal framework consisting of directives, regulations, decisions, and strategic documents that form the legal basis for countering terrorism in the EU.

CONSTRUCTIVE AND CRITICAL ANALYSIS OF PREPARATORY PROCEEDINGS IN CIVIL LITIGATION

The article analyzes the provisions of the Code of Civil Procedure on preparatory proceedings, the stages of these proceedings, the systematization of actions for filing a response to a claim, the submission of explanations by third parties regarding the claim or response, third-party claims with independent claims for counterclaims, securing claims, combining and separating claims, responding to statements of defense and objections, the timing of these proceedings, and the procedure for exchanging procedural documents, etc.
