TO THE QUESTION ABOUT ACCESS TO ECOLOGICAL INFORMATION AND PARTICIPATION IN THE PROCESS OF ACCEPTANCE ECOLOGICALLY OF MEANINGFUL DECISIONS

 

 

To the ecolaws of citizens, in particular, a right belongs on open access to ecological information and possibility of participation of public in the process of acceptance ecologically of meaningful decisions. The great attention is given on public relations in this sphere.

Aarhus Convention is a new type of agreement in the field of the guard of environment. It’s object directly touches mutual relations between society and management organs and is an important instrument in relation to participating of public in making decision, access to information and justice on questions that touch an environment.

Determining the features of practical realization of positions of national legislation in relation to access to ecological information and possibilities of participation of public in the process of acceptance ecologically of meaningful decisions, authors analyse to the article 4-9 of Aarhus Convention on the examples of enforcement practice of courts of Ukraine and taking into account corresponding world standards.

On the basis of analysis of separate positions of current legislation about access to ecological information marked, that state information environment is one of basic directions of informative activity.

In the article drawn conclusion about importance of fixing in the legislation of even development of both active and passive aspect of duty of grant of information.

But, administrative events for the ungrant of information are taken only to the duty of her to give. Approvals are for a refuse in the grant of ecological information, that is at disposal of certain subjects, does not exist. Fixing at legislative level of such approvals will assist the proper realization of right on access to ecological information - only right.
