SEPARATE QUESTIONS OF THE PARTICIPATION OF A LAWYER IN THE PROCESS OF PROVING THE CIRCUMSTANCES OF THE RELEASE FROM CRIMINAL LIABILITY

Based on the study of the current legislation, by-laws and scientific sources, the article analyzes the provisions for proving by a defender main facts that are the basis for exemption from criminal responsibility as a result of reconciliation between perpetrator and victim.

The article determines the key elements of the compromise maintaining procedure, that stipulates participation of attorney within the framework of exemption of individual from criminal responsibility mechanism as a result of reconciliation between perpetrator and victim. Analyzed scientific sources regarding the protection side problems as to rapid receipt and fixing of evidence in criminal proceedings. The author covers the problems of the practical nature of compensation for harm and loss.

Particularly the article explores the features of compensation for moral harm within the exemption from criminal responsibility as a result of reconciliation between the perpetrator and victim. Based on the analysis of scientific research and jurisprudence, it is determined that for today there is no uniform methodology for compensation of moral harm, which leads to ambiguous practical application. Based on the analysis of the norms of legislation, scientific research and law-enforcement jurisprudence identified gaps that require attention of legislator, and proposals for their elimination are provided.
