THE ROLE OF THE PRESIDENT OF UKRAINE IN THE REMOVAL FROM OFFICE OF A PERSON SUSPECTED OF COMMITTING A CRIME
The author researched the regulation of issues of removal from office of persons appointed by the President of Ukraine, which is enshrined in the first sentence of Part 3 of Article 154 of the CCP. It is noted that the norms of Part 3 of Art. 157 of the CCP do not appear to be perfect because they do not provide an answer as to who exactly the President of Ukraine has the right to remove from office. In accordance with the powers of the President of Ukraine enshrined in Art. 106 of the Constitution of Ukraine, the President of Ukraine, in most cases, has the authority to appoint only a certain part of the composition of individual bodies. It is claimed that the President of Ukraine cannot exercise the powers delegated to the court by the Constitution of Ukraine, because according to Art. 124 of the Constitution of Ukraine: «Delegation of court functions, as well as appropriation of these functions by other bodies or officials, are not allowed». Attention is drawn to the fact that: – the procedure for consideration by the President of Ukraine of motions to remove persons from office deprives such person of the right to protection and is carried out in conditions of non-competitiveness; – The President of Ukraine, considering the issue of removal from office of persons whom he himself appointed, or initiated their appointment, acts in such a situation under the conditions of a certain conflict of interests; The President of Ukraine may in a certain way be bound by political issues when making such a decision, which harms his reputation. It is proposed to amend Art. 154 of the Criminal Procedure Code, which would grant the right to remove all persons from office exclusively by the investigating judge or the court, depending on the stage of the criminal proceedings at which the issue is being considered.
