RIGHTS OF CLOSE RELATIVES AND FAMILY MEMBERS OF PERSONS MISSING UNDER SPECIAL CIRCUMSTANCES: PROBLEMATIC ISSUES AND PROSPECTS FOR RESOLUTION.

The article examines certain problematic aspects faced by close relatives and family members of persons missing under special circumstances regarding their rights guaranteed by the legislation of Ukraine, particularly the Law of Ukraine “On the Legal Status of Persons Missing under Special Circumstances.” A scientific and practical analysis of certain provisions of this law is conducted, highlighting problematic aspects of its implementation. Identified shortcomings of the regulatory framework include: fragmented functions distributed among law enforcement and military agencies, which exacerbates the situation concerning the protection of the rights of missing persons and their families; ineffective practical implementation of action algorithms developed by relevant authorities for close relatives and family members of missing persons; inconsistencies and lack of adaptation of the regulatory framework in the field of protection and safeguarding the rights of close relatives and family members of persons missing under special circumstances to address current challenges; and the absence of a Unified Information Platform consolidating all data on persons missing under special circumstances to facilitate their search.
