FROM COMPLAINT TO STATEMENT OF CLAIM:
HISTORICAL AND LEGAL ANALYSIS OF THE INTRODUCTION
AND DEVELOPMENT OF THE STATEMENT OF CLAIM FORM OF APPEAL TO THE COURT
IN ADMINISTRATIVE JUSTICE IN UKRAINE
The right to judicial protection of subjective rights, freedoms, and legitimate interests of individuals in the public-legal sphere includes the right of an individual to appeal to an administrative court. The introduction of administrative justice has led to a transformation in views on the need to replace the outdated form of appeal to the court in the form of a “complaint” with a “statement of claim,” the use of which is not without certain shortcomings. However, these are insignificant and can be easily eliminated by amending the procedural legislation.
Keywords: right to appeal to the court, right to judicial protection, administrative proceedings, complaint, statement of claim, administrative claim.
