БАЗОВІ ПРИНЦИПИ ЗАСТОСУВАННЯ ПРАКТИКИ ЄВРОПЕЙСЬКОГО СУДУ З ПРАВ ЛЮДИНИ СЛІДЧИМ СУДДЕЮ В НАЦІОНАЛЬНОМУ КРИМІНАЛЬНОМУ СУДОЧИНСТВІ
Розглядається процес узгодження відповідних норм міжнародного права у сфері прав людини з нормами внутрішнього права і законодавче закріплення в ньому міжнародних стандартів, що є необхідним засобом забезпечення їх виконання на рівні правозастосовної практики держави і належного виконання цих стандартів її національними установами. Зазначається, що саме за допомогою судової процедури вдається найбільш справедливо визначити міру свободи та міру відповідальності суб’єктів правовідносин.
