ОКРЕМІ АСПЕКТИ ЗДІЙСНЕННЯ СПЕЦІАЛЬНОГО ДОСУДОВОГО РОЗСЛІДУВАННЯ ТА РОЛЬ ЗАХИСНИКА В ЦЬОМУ ПРОЦЕСІ

У статті проаналізовано окремі науково-теоретичні напрацювання сучасної юридичної науки в дослідженні кримінального провадження за відсутності підозрюваного (обвинуваченого), визначено природу та сутність такого провадження, наведено приклади української та європейської судової практики, що пов’язані із здійсненням спеціального досудового розслідування за відсутності підозрюваного (обвинуваченого). Метою даної статті є науково-теоретичний і практичний аналіз окремих аспектів здійснення спеціального досудового розслідування та ролі адвоката-захисника у цьому процесі, виявлення проблемних питань у правовому регулюванні та надання пропозицій для їх вирішення.

Ключові слова: досудове розслідування, спеціальне досудове розслідування, право на професійну правничу допомогу, право на захист.
