НЕЗАЛЕЖНІСТЬ СУДДІ ЯК СКЛАДОВА ПРИНЦИПУ ВЕРХОВЕНСТВА ПРАВА

Стаття присвячена аналізу нормативно-правового забезпечення незалежності судової влади в Україні. Розглянуто передумови забезпечення незалежності суду з точки зору наявності політичної волі, практичного дотримання суддями стандартів суддівської етики, а також у взаємозв’язку з їх дисциплінарною відповідальністю. Доведено, що незалежність судової влади є необхідною умовою реалізації права людини на справедливість правосуддя і принципу верховенства права. Проаналізовано нормативно-правові акти, що були прийняті в рамках судової реформи 2016 року, на відповідність пункту 1 статті 6 Конвенції про захист прав людини і основоположних свобод. Зроблено висновок про досягнення певних зрушень у забезпеченні незалежності суддів та запропоновано правові механізми, запровадження яких, на думку автора, зменшить можливості для втручання у суддівську незалежність.
