МІЖНАРОДНІ СТАНДАРТИ У ЗАБЕЗПЕЧЕННІ ПРАВА НА АПЕЛЯЦІЙНЕ ОСКАРЖЕННЯ (КРИМІНАЛЬНО-ПРОЦЕСУАЛЬНИЙ АСПЕКТ)

Сьогодні невизначеним залишається розуміння закріпленої у пункті 8 частини другої статті 129 Конституції України основної засади судочин-ства – забезпечення права на апеляційний перегляд справи, оскільки  не-зрозумілими є аспекти обсягу цього права. У статті проаналізовано між-народні стандарти забезпечення права на апеляційне оскарження, які хоча й стосуються  більшою мірою перегляду у кримінальних справах, однак можуть стати дороговказом у розумінні аспектів обсягу конституційного права на апеляційний перегляд справи.

Ключові слова: забезпечення права,апеляційний перегляд справи, пра-во на апеляційне оскарження, міжнародні стандарти.
