ПРАВО НА ПОВАГУ ДО СІМЕЙНОГО ЖИТТЯ В КОНТЕКСТІ СТАТТІ 8 КОНВЕНЦІЇ ПРО ЗАХИСТ ПРАВ ЛЮДИНИ І ОСНОВОПОЛОЖНИХ СВОБОД

Аналізуються підходи до тлумачення Європейським судом з прав людини поняття «сімейне життя», право на повагу до якого гарантується статтею 8 Конвенції про захист прав людини і основоположних свобод та межі її застосування. Досліджується практика застосування цієї статті Європейським судом та її значення для національної правової системи при розгляді судами спорів, які виникають із сімейних відносин, а також критерії оцінки Судом допустимості втручання у право на повагу до «сімейного життя» за практикою Суду.
