ПОВНОВАЖЕННЯ КОНСТИТУЦІЙНИХ СУДІВ ЩОДО РОЗГЛЯДУ ВИБОРЧИХ СПОРІВ: ПОРІВНЯЛЬНО-ПРАВОВИЙ АСПЕКТ

У статті досліджуються проблеми правового регулювання виборчих спорів як складової компетенції конституційних судів. Зокрема, відзначається, що на зміст визначення виборчих спорів суттєво впливають особливості конституційного регулювання зазначеного питання в конкретній державі. Так, класичне визначення виборчого спору як спору, що виникає в результаті порушення виборчого права, є досить загальним, оскільки включає в себе в тому числі і захист виборчих прав шляхом конституційної скарги. Однак конституційна скарга є винятковим та спеціальним засобом правового захисту гарантованих конституцією прав людини, тоді як вирішення конституційним судом виборчих спорів є іншим, оригінальним, механізмом захисту виборчих прав. Також із визначення виборчого спору, що підлягає розгляду в конституційному суді, повинні бути виключені і спори про конституційність нормативних актів, що регулюють питання призначення, проведення та встановлення результатів виборів, оскільки нормоконтроль являє собою повноваження, відмінне від повноваження по вирішенню виборчих спорів.
