РЕАЛІЗАЦІЯ СПЕЦІАЛЬНОГО ПРИНЦИПУ МІЖНАРОДНОГО ЗАХИСТУ ПРАВ ДИТИНИ – ЯКНАЙКРАЩОГО ЗАБЕЗПЕЧЕННЯ ЇЇ ІНТЕРЕСІВ У ВНУТРІШНЬОМУ ПРАВІ УКРАЇНИ

РЕАЛІЗАЦІЯ СПЕЦІАЛЬНОГО ПРИНЦИПУ МІЖНАРОДНОГО ЗАХИСТУ ПРАВ ДИТИНИ – ЯКНАЙКРАЩОГО ЗАБЕЗПЕЧЕННЯ ЇЇ ІНТЕРЕСІВ У ВНУТРІШНЬОМУ ПРАВІ УКРАЇНИ
Стаття присвячена визначенню відповідності українського законодавства міжнародним стандартам; проаналізовано, як відображено у ньому принцип якнайкращого забезпечення інтересів дитини – спеціальний принцип міжнародного захисту її прав.
Інститут міжнародного захисту прав дитини являє собою сукупність міжнародно-правових принципів і норм, які визначають права і свободи дітей, що встановлюють зобов’язання держав по забезпеченню і практичному перетворенню в життя (реалізації) цих прав і свобод, а також міжнародні механізми контролю за виконанням державами своїх міжнародних зобов’язань.
Україна належно виконує зобов’язання, які має відповідно до Конвенції про права дитини. Принцип найкращого забезпечення інтересів дитини як спеціальний принцип міжнародного захисту її прав отримав реалізацію шляхом удосконалення національного законодавства за останні роки.
Ключові слова: міжнародне право, національне законодавство, міжнародний захист прав дитини, принцип якнайкращого забезпечення інтересів дитини.
