ПРАВОВІ ПОЗИЦІЇ В АКТАХ ІНТЕРПРЕТАЦІЙНОЇ ФОРМИ ПРАВОТВОРЧОЇ ДІЯЛЬНОСТІ

У статті розглянуто правові позиції як правову категорію – наслідок офіційного тлумачення, яка підкреслює його правотворчий характер. Вони закладені в інтерпретаційних актах Конституційного Суду України. Правові позиції є визнаними наукою джерелами розуміння правових норм. Вони мають нормативні ознаки, які нагадують ознаки нормативно-правових актів. Відмежування правотворчості від офіційного тлумачення, із врахуванням сучасних реалій, мають умовний характер. Діяльність Конституційного Суду із офіційного тлумачення слід розглядати як особливий вид правотворчої діяльності – інтерпретаційну правотворчість.
