ВИКОНАННЯ ДОГОВОРУ ДОВІЧНОГО УТРИМАННЯ: ПРОБЛЕМИ ТЕОРІЇ ТА ПРАКТИКИ ЗАСТОСУВАННЯ

У статті визначено, що основними випадками невиконання або неналежного виконання набувачем своїх обов’язків за договором довічного утримання є: 1) надання відчужувачу не тільки грошового утримання, а й відповідного догляду, якщо це передбачено умовами договору; 2) надання утримання не повинно мати епізодичний характер (періодичні дії) або надання допомоги частково чи певної допомоги, яка не є доглядом у розумінні вимог договору довічного утримання; 3) невиконання або неналежне виконанням набувачем обов’язку поховання, оплати ритуальних послуг та встановлення надгробку за договором довічного утримання.
