ЦИВІЛЬНО-ПРАВОВА ХАРАКТЕРИСТИКА ОКРЕМИХ ДОГОВІРНИХ ЗОБОВ’ЯЗАНЬ ФОНДУ ГАРАНТУВАННЯ ВКЛАДІВ ФІЗИЧНИХ ОСІБ

Дана стаття присвячена характеристиці окремих договірних зобов’язань Фонду гарантування вкладів фізичних осіб, зокрема, таких, як: договір позики, уступки права вимоги, інвестиційний договір за участю Фонду та ін. На основі досліджень у даній сфері зроблено висновок, що умовно договірні зобов’язання, у які вступає Фонд, можна поділити на договори, що спрямовуються на реалізацію функцій Фонду, а також на ті, що спрямовані на підтримку та збільшення майнової основи Фонду, що в кінцевому результаті також має своє спрямування на реалізацію його функцій. У рамках даного дослідження зосереджено увагу на проблемі забезпечення концептуальних засад договірного права на рівні підзаконних нормативно-правових актів Фонду.

Ключові слова: Фонд гарантування вкладів фізичних осіб, функції Фонду, договір, істотні умови договору.
