ВІДВІД СУДДІ У ГОСПОДАРСЬКОМУ ПРОЦЕСІ: ОКРЕМІ ПИТАННЯ ТЕОРІЇ ТА ПРАКТИКИ

У статті досліджуються питання відводу судді у господарському процесі та підстав для його заявлення, розглядаються суперечливі позиції щодо наявності (відсутності) підстав для заявлення відводу суддів при новому розгляді справи та перегляді судових рішень за нововиявленими обставинами. Вносяться пропозиції щодо доповнення норм Господарського процесуального кодексу України, що визначають перелік підстав для відводу судді.

Ключові слова: відвід судді, безсторонність, спеціалізація суддів, новий розгляд, нововиявлені обставини.
