ОЦІНКА ДОКАЗІВ У ЦИВІЛЬНОМУ ПРОЦЕСІ

Стаття присвячена дослідженню оцінки доказів у цивільному судочинстві. Проаналізовано елементи процесуальної форми оцінки доказів судом та критерії, за якими вона здійснюється, наведено приклади оцінки достовірності доказів. Встановлено, що діяльність осіб, які беруть участь у справі, з аналізу доказів в процесі пізнання в судовому доказуванні не відноситься до оцінки, єдиним суб’єктом якої є суд. Запропоновано визначення оцінки доказів у цивільному процесі.
