ВЕРХОВЕНСТВО ПРАВА – НОВИЙ «СТАРИЙ» ПРИНЦИП ЦИВІЛЬНОГО СУДОЧИНСТВА: СПІВВІДНОШЕННЯ ІЗ ПРИНЦИПОМ ЗАКОННОСТІ

Стаття присвячена питанням інтегрованого розуміння верховенства права як певного стандарту в аспекті судового тлумачення та правозастосування, що, як наслідок, впливає на ефективність цивільного судочинства. Доведено, що базовими концептами для судді як інтерпретатора закону повинні виступати субстантивний елемент верховенства права, який полягає в тому, що під час усієї діяльності суддя повинен виходити із каталогу основоположних прав людини та їх пріоритетності, а також формальний елемент верховенства права, згідно з яким суддя має виходити з принципу законності (у значенні правовості законів), принципу пропорційності, принципу правової визначеності та процесуальних гарантій права на справедливий судовий розгляд.
