УМОВНО-ДОСТРОКОВЕ ЗВІЛЬНЕННЯ ВІД ВІДБУВАННЯ ДОДАТКОВОГО ПОКАРАННЯ СУБ’ЄКТІВ ПРОБАЦІЇ: НОРМАТИВНІ ТА ПРИКЛАДНІ ПРОБЛЕМИ

У статті досліджено і проаналізовано законодавче врегулювання та практичне застосування інституту умовно-дострокового звільнення від відбування додаткового покарання суб’єктів пробації. На основі вивчення судової практики відзначено існування прямо протилежного вирішення зазначеного питання у різних регіонах, що негативно впливає на усталеність практики, що перешкоджає єдиному праворозумінню і ставить під питання дотримання принципу справедливості загалом. На основі докладного вивчення і аналізу правової та соціальної природи зазначеного інституту наголошується, що з урахуванням того гуманного значення, який він має, цілком виправданим є його розширене застосування до засуджених, у тому числі й при відбуванні додаткового покарання. Відповідно до цього і утверджується, що уповноважені органи з питань пробації, як органи виконання кримінальних покарань, мають право відповідно до вимог КК і КПК України звертатися до суду з клопотанням про умовно-дострокове звільнення суб’єктів пробації від відбування додаткового по-карання.
