ДИСЦИПЛІНАРНА ВІДПОВІДАЛЬНІСТЬ СУДДІ ЗА ЮРИДИЧНУ ПОМИЛКУ: ПОРІВНЯЛЬНО-ПРАВОВА ПЕРСПЕКТИВА В КОНТЕКСТІ ПРИНЦИПУ СУДОВОЇ НЕЗАЛЕЖНОСТІ

Досліджено загальнотеоретичні умови притягнення судді до дисциплінарної відповідальності за юридичну помилку. Вивчено підстави такої відповідальності у Франції та США, проаналізовано сучасний стан міжнародного права у цій сфері. Виділено та розглянуто основні ознаки об’єктивної та суб’єктивної сторони дисциплінарного проступку судді, в основі якого лежить юридична помилка. Визначено зовнішні чинники, які впливають на правильність підходу у дисциплінарно-правовій кваліфікації юридичної помилки судді.

Ключові слова: юридична помилка, дисциплінарний проступок, дисциплінарна відповідальність.
