ЕФЕКТИВНИЙ СПОСІБ СУДОВОГО ЗАХИСТУ ПРИВАТНОГО ПРАВА ТА ІНТЕРЕСУ ЯК КАТЕГОРІЯ ПРОЦЕСУАЛЬНОГО ПРАВА

Стаття присвячена дослідженню та аналізу новели цивільного процесуального законодавства «ефективний спосіб судового захисту» приватного права та інтересу як правової категорії процесуального права. Констатується, що ефективний спосіб захисту приватного права або інтересу слід розглядати як сукупну правову категорію, де трикутник «ефективне – захист – право» – це його складові, які й утворюють єдиний процесуальний механізм. Обґрунтовуються окремо та у їх взаємозв’язку правові категорії «ефективний спосіб судового захисту», «визначення судом ефективного способу захисту», «спосіб захисту, який не суперечить закону» на основі аналізу практики ЄСПЛ та національних судів.

Ключові слова: ефективний захист порушеного, невизнаного або оспорюваного права; ефективний спосіб судового захисту; визначення судом ефективного способу захисту; спосіб захисту, який не суперечить закону; доступ до правосуддя; ефективний засіб юридичного захисту.
