РОЛЬ СУДОВОЇ ПРАКТИКИ У ПРАВОВОМУ РЕГУЛЮВАННІ ДОГОВІРНИХ ВІДНОСИН ЗІ СТРАХУВАННЯ

Стаття присвячена визначенню сутності, ролі та значення судової практики у правовому регулюванні договірних відносин зі страхування, встановленню її характерних ознак та співвідношення з іншими джерелами правового регулювання відповідних відносин. Наголошується, що судова практика є результатом судового регулювання, впливає на практику правозастосування, фактичне формування страхових відносин у суспільстві, зміну страхового законодавства та посідає важливе місце в соціальному регулюванні.

Ключові слова: судова практика, правове регулювання, договірні відносини зі страхування, джерела правового регулювання, позаюридичні джерела, соціальні регулятори
