ЗАБЕЗПЕЧЕННЯ БАЛАНСУ ІНТЕРЕСІВ У СПОРАХ ЩОДО ОБОВ’ЯЗКОВОСТІ ПРОФІЛАКТИЧНИХ ЩЕПЛЕНЬ

Встановлення обов’язкових профілактичних щеплень породжує проблему їх співвідношення з правом на особисту недоторканність і необхідністю згоди на медичне втручання. Особливої гостроти цій проблемі додають встановлені обмеження на реалізацію окремих прав громадян. Метою цієї статті є конкретизація критеріїв оцінки балансу інтересів у спорах щодо обов’язковості профілактичних щеплень.

У дослідженні обґрунтовано, що такими критеріями виступають законність і пропорційність втручання; конкретизовані критерії оцінки пропорційності та підстави відшкодування шкоди особі, якій проведено профілактичне щеплення.

Ключові слова: медичне втручання, право на особисту недоторканність, обов’язкові профілактичні щеплення, право на освіту, пропорційність втручання у права людини, критерії оцінки балансу інтересів
