УРАХУВАННЯ ПРАВОВИХ ПОЗИЦІЙ ЄВРОПЕЙСЬКОГО СУДУ З ПРАВ ЛЮДИНИ ПРИ ЗДІЙСНЕННІ ПРАВОСУДДЯ В УКРАЇНІ

У статті за результатами дослідження запропонований алгоритм урахування правових позицій Суду Ради Європи при здійсненні національного правосуддя, встановлені виключні умови, за яких суд може не послуговуватися правовими позиціями Європейського суду з прав людини, а також критерії релевантності урахування правових позицій Страсбурзького суду при здійсненні правосуддя в Україні.

Ключові слова: урахування, правові позиції, Європейський суд з прав людини, релевантність, усталена судова практика, тлумачення конвенційних норм.
