ПОВНОВАЖНІ СУБ’ЄКТИ РОЗСЛІДУВАННЯ ВОЄННИХ ЗЛОЧИНІВ В УКРАЇНІ: КРИМІНАЛЬНИЙ ПРОЦЕСУАЛЬНИЙ АСПЕКТ У ПИТАННЯХ ДОКАЗУВАННЯ

У статті йдеться про важливість використання таких юридичних категорій і понять, як «воєнні злочини», «суб’єкти розслідування», «збирання доказів воєнних злочинів» у чіткій відповідності до їх дійсного правового змісту, без нашарувань емоційності та розширення їх значення у зв’язку із екстраординарними умовами воєнного стану. Правильність їх розуміння є принциповою з огляду на взаємозалежність уповноваженого суб’єкта збирання доказів воєнних злочинів в Україні та допустимості доказів, що має наслідком ефективність досудового розслідування, якість судових рішень та показник справедливості й законності правосуддя в державі.

Ключові слова: воєнні злочини, суб’єкти розслідування, суб’єкти збирання і фіксації доказів, сторони кримінального провадження, допустимість доказів.
