СУЧАСНІ НАПРЯМИ РОЗВИТКУ СУДОВОЇ ПРАКТИКИ ВИРІШЕННЯ СПОРІВ ПРО ВИЗНАЧЕННЯ МІСЦЯ ПРОЖИВАННЯ ДИТИНИ

Стаття присвячена вдосконаленню підходів до вирішення судами спорів про визначення місця проживання малолітньої дитини. Наголошено на доцільності застосування судами не тільки однієї моделі (варіанта) визначення місця проживання малолітньої дитини – з одним із батьків (із потенційним забезпеченням контакту другого із батьків з дитиною), а і впровадження інших способів (варіантів) вирішення спорів між батьками про визначення місця проживання малолітньої дитини, таких як: спільна фізична опіка з почерговим проживанням дитини у помешканні кожного із батьків за відповідним графіком; визначення місця проживання дитини у помешканні, в якому дитина проживала раніше, з почерговим проживанням батьків у цьому помешканні згідно з узгодженим графіком.

Ключові слова: фізична опіка над дитиною, судові спори між батьками щодо визначення місця проживання дитини.
