ДО ПИТАННЯ ЩОДО ПОШИРЕННЯ ГАРАНТІЙ  КРИМІНАЛЬНОГО ПРОЦЕСУ НА ДИСЦИПЛІНАРНЕ ПРОВАДЖЕННЯ СТОСОВНО СУДДІВ

         Розглянуто питання, чи повинні гарантії кримінального процесу поширюватися на суддів під час дисциплінарного провадження. Констатовано, що відповідно до практики ЄСПЛ гарантії кримінального процесу не поширюються на суддів під час дисциплінарних проваджень. Дисциплінарні провадження підпадають під дію цивільної частини ст. 6 Конвенції про захист прав людини і основоположних свобод.

Ключові слова:дисциплінарна відповідальність суддів, критерії Енгеля, пре­зумпція невинуватості, право не бути притягненим до суду або покараним двічі.
