ТЕНДЕНЦІЇ РОЗВИТКУ ПРАКТИКИ ВЕРХОВНОГО СУДУ

В КРИМІНАЛЬНИХ СПРАВАХ: ПРОЦЕСУАЛЬНИЙ АСПЕКТ

У статті оглядово висвітлюються висновки щодо застосування норм КПК України, сформовані Верховним Судом за період його функціонування.

Окреслюються тенденції розвитку практики Верховного Суду в кримінальних справах і зазначається, що внаслідок зміни правових позицій окремі недоліки процесуальної діяльності сторони обвинувачення більше не визнаються істотними порушеннями КПК України, що також позбавляє сторону захисту можливості апелювати до них.  Звертається увага на пов’язані з цим ризики, що можуть виникнути в довгостроковій перспективі.
