ABOUT THE POSSIBILITY OF THE ‘RETROACTIVE’ USE OF THE ITEMS 2 AND 3 OF THE FIRST PART OF ARTICLE 445 OF THE CRIMINAL PROCEDURE CODE OF UKRAINE BY THE SUPREME COURT OF UKRAINE

The article contains the analysis of the questions of the possibility of the ‘retroactive’ use of the statements which provisions the conditions of the reviews of the determinations of the Court of Cassation by the Supreme Court of Ukraine. This is due to the facts that the Court of Cassation makes the different use of the same criminal procedure statements and at the result of this kind of use there are the determinations of the Court of Cassation with the different contents or due to the facts that the determinations of the Court of Cassation doesn’t correspond to the conclusion of the Supreme Court of Ukraine of the general use of criminal procedure statement by the Court of Cassation.
