THE QUESTION OF LEGAL INTERPRETATION OF THE GROUNDS FOR COVERT SURVEILLANCE (DETECTIVE ACTIONS) BEFORE THE INVESTIGATING JUDGE’S RESOLUTION

 

In the article, there is presented the author’s view of issues of legal interpretation of the grounds for covert surveillance (detective actions) before the investigating judge’s resolution. There is shown the own position on current theoretical problems. In particular, there the attention is paid to the wording imperfection of the legal grounds of covert surveillance (detective actions) in urgent cases “of saving people’s lives and preventing the grave or especially grave crime”, because, in some cases, the need for these actions appears with the aim to identify (direct persecution) a person, who committed a grave or especially grave crime. In addition, there is subjected to critical evaluation the legal structure, that provides a combination of grounding components for starting the covert surveillance (detective actions) without investigating judge’s resolution as saving people’s lives and preventing the grave or especially grave crime, using a coordinate conjunction “and”. There are made offers to amend the wording of p. 1, art. 250 of the Cirimnal Procedure Code, by replacing the coordinate conjunction “and” with the disjunctive “or”. There are listed the arguments against the selectivity in the formation of the crimes list, where it is permitted to start the covert surveillance (detective actions) without investigating judge’s resolution. There is grounded the conclusion about the fact that the reason for opportunity to start covert surveillance (detective actions) before investigating judge’s resolution, should not be formulated by the list of separate sections of the Special Part of the Criminal Code of Ukraine, but it should be only as an indication of the appropriate severity of a criminal offense (grave and especially grave crimes).
