PROCEDURAL COMPULSION IN THE LEGAL SYSTEM OF UKRAINE:FORMULATION OF THE PROBLEM

 

The article examines the legal regulation of procedural measures of criminal, administrative, civil and commercial matters and matters concerning the application of financial, administrative, economic penalties, fines for providing solution of specific individual cases on bringing of guilty persons to justice as well as the resolution of a legal dispute or a dispute about rights. Procedural measures to ensure proceedings are considered in the light of the legal system of integrated phenomenon, as an institution of procedural coercion in the legal system of Ukraine.

Until now the procedural measures researches of proceedings in legal literature are implemented on the basis of characteristics on sectoral direction of consideration and resolution of specific criminal, civil, administrative and commercial cases and cases of administrative offenses.

In this regard, the author attempted to summarize various measures to ensure the proceedings and to produce certain measures for use in civil, administrative, economic and administrative-tortious proceedings. The author particularly draws attention to the lack of definition in law measures to ensure the proceedings on the application of financial, administrative, economic penalties, fines, that can lead to numerous power abuses. Uncertainties of procedure of applying these sanctions is doubtful for a comprehensive, complete and objective solution of the merits.
