CONCERNING THE CASES OF DETENTION SUSPECTED PERSON BY AN AUTHORIZED OFFICER

The main idea of the article is an analysis of the grounds provided by Art. 208 CPC of Ukraine. The author is to be interpreted by the participants in the criminal proceedings in different ways, which leads to unequal, and sometimes mistaken application of Art. 208 CCP of Ukraine and illegal detention. Accordingly, this may contribute to the violation of the right to liberty and security of person. The article establishes that cases in which an authorized official has the right, without the order of an investigating judge, to detain a person suspected of committing an offense punishable by deprivation of liberty containing appraisal concepts (direct commission of a crime “and” just committed a crime“) And needs improvement. The main reason for challenging the lawfulness of a person’s detention in the order of Art. 208 of the CPC of Ukraine is that investigators, prosecutors detain a person on the basis of clause 1.2, part 1, Article. 208 of the CPC of Ukraine if after a crime has passed a long period of time that is not covered by the term “immediately after the crime” and “just committed a crime”. Detention in accordance with Art. 208 of the CPC of Ukraine is considered unlawful if it was carried out at a time which exceeded several hours (8-10 hours 2.5%, 1 day – 17%, 2 and more days - 59.5%). In the event that after the crime has passed a period of time which does not correspond to the features specified in clauses 1 and 2, part 1, Article. 208 of the CPC of Ukraine (“during the commission of a crime”; “immediately after the commission of a crime”; “once committed a crime”) grounds for detention in accordance with art. There are no 208 CPCs in Ukraine.
