JUDGMENTS OF THE EUROPEAN COURT OF HUMAN RIGHTS VERSUS UKRAINE: HOW THEY HAVE CHANGED THE ADJUDICATION IN UKRAINE?

 

The article is dedicated to the analysis of influence of the ECtHR jurisprudence on the Ukrainian jurisprudence.

Starting from the parliamentary debate while ratifying ECHR by Verkhovna Rada on July 17, 1997 with particular interest on protection rights guaranteed by Article 6 of the Convention and Article 1 of Protocol No. 1 to the Convention, especially in respect of salary/remuneration, a systemic problem of non-enforcement or delayed enforcement of domestic court decisions, combined with the absence of effective domestic remedies in respect of such shortcomings is highlighted, with reference to the Ivanov pilot judgment and recent Grand Chamber judgment in the case of Burmych and Others v. Ukraine.

Also, informational, ideological, social and legal aspects of the influence has been distinguished. General legal (legal culture, legal consciousness, legal principles), and specific (norms, normative legal provisions, normative legal acts, legal enforcement acts) legal means are analyzed and some bright and relevant examples are highlighted.

It is outlined that both general and specific legal means have been initially an object of influence of the ECtHR jurisprudence, and then became means of such influence. It is outlined that the influence of the ECtHR jurisprudence can be visible not only in promotion of the new legal concepts (i.e. justification of infringement, «necessary in a democratic society», «balance of rights», «legal certainty») but in adopting new norms, normative legal provisions and the normative legal acts developed on the basis of the ECtHR standards.

Taking into account the role of the Supreme Court some judgments of the SC that contain references to four remarkable ECtHR judgments against Ukraine on violation of Article 6 of the Convention, namely Pronina, Belukha, Sokurenko and Strugyn, Seryavin and Others are analyzed. Some tendencies for implementation of the ECtHR jurisprudence by the SC are identified.
