METHODOLOGICAL GUIDELINES FOR THE SELECTION OF SHOTS FOR THE SYSTEM OF JUSTICE

 

 

The article investigates the issues of methodological guidelines for conducting a qualification assessment of judges and a qualification examination in the process of selecting candidates for the position of a judge of a local court, and some issues of raising the professional level of judges as the main criterion for promotion of a judge in professional careers.

Recently Ukraine’s constitutional provisions regarding judiciary were changed, opening the door for a full-fledged judicial reform.

According to the Law of Ukraine «On the Judicial System and Status of Judges» the National School of Judges of Ukraine is a public institution with a special status that provides training of qualified personnel for the judicial system and leads research activities.

Thus, legally and practically the National School of Judges of Ukraine is the special body responsible for organizing and conducting initial training for candidates to a judicial position, and in-service training for judges and court staff.

Qualification assessment of judges, including initial and repeated qualification assessment of judges is aimed to evaluate and to improve quality

judge`s professional activity.

Qualification assessment is aimed to check the capacity of judges and candidates to judicial positions to confirm the judges professional level in view of lifetime appointment.

The initial and repeated qualification assessment is aimed at validating the judge’s professional level in order to decide whether he is capable of dispensing the justice at the relevantcourt.

Consequently the process of selecting candidates for a judge’s position is the participation of lawyers with diametrically opposed knowledge and experience of work - lawyers, scholars, and human rights activists, which will allow to multiply effect of judicial reform and combine the best modern practices.
