TREASON AND COLLABORATION: ISSUES OF CRIMINAL LAW QUALIFICATION

 

After the beginning of the war of the Russian Federation against Ukraine the legislator repeatedly made changes to the criminal and criminal procedural codes of Ukraine. This fact indicates that, in the opinion of the legislator, the existing provisions of these codes were not fully adapted for application during the war.

This article is devoted to a comprehensive study of the problems of criminal law assessment of acts that are collaborative activities. The purpose of this article is to determine the relationship between treason and collaboration, between the composition of criminal offenses defined by Articles 111 and 111-1 of the Criminal Code of Ukraine and the formulation of scientifically sound proposals for criminal assessment of acts that contain elements of relevant criminal offenses.

Given the fact that the amendments to the Criminal Code of Ukraine in terms of its addition to Art. 111-1 "Collaborative activities" took place immediately after the start of a full-scale war of the Russian Federation against Ukraine, the question of timeliness and the need for such a detailed analysis of these criminal offenses against the foundations of national security of Ukraine is beyond doubt.

After all, there is practically no scientific research on the content and relationship between treason and collaborationism, but law enforcement and judicial authorities are already actively using these components of criminal acts in practice. The paper analyzes the existing scientific positions and legislation on this issue. In particular, each of the forms of collaborative activity was investigated in detail and arguments were made as to whether there were signs of one of the investigated components of criminal offenses against the foundations of national security.

Approaches to the criminal-legal qualification of acts that contain signs of "Collaborative activity" are proposed and conclusions are made about the possibility of qualifying this composition of a criminal offense in conjunction with treason.
