IMPLEMENTATION OF THE PRINCIPLES OF JUDICIAL PROCEDURE IN THE ACTIVITIES OF THE CONSTITUTIONAL COURT OF UKRAINE (THEORETICAL AND LEGAL ASPECT) 

The article considers the theoretical and legal aspects of the principles of judicial procedure, their correlation with the principles of law and clarifies the problems of their implementation in the activities of the body of constitutional jurisdiction. The features of the principles of judicial procedure are determined, the author's understanding of them is substantiated. The principles of judicial procedure are defined as the initial ideas and provisions enshrined in the Constitution of Ukraine and codified acts of substantive and procedural law, decisions of international courts, which have a general, imperative nature, determine the procedure and content of the implementation and improvement of judicial procedure.

It is emphasized that the principles of law are primary in nature, under their influence the principles of judicial procedure are formed, the principles of legal procedure are specified in the principles of judicial procedure, which constitute the normative basis of judicial procedure.

The implementation of the principles of judicial procedure in the activities of the Constitutional Court of Ukraine is illustrated in the aspect of recognizing regulatory acts or their parts as constitutional; compliance with the Constitution of Ukraine of the current international treaties of Ukraine and acts that make amendments and supplements to the Constitution of Ukraine. Special attention is paid to the analysis of the interpretation of the principles of judicial proceedings in its decisions.

These are the principles of the rule of law, legal certainty, immutability of judges, unity of the status of judges, independence of judges, proportionality, reasonableness, legal predictability, legitimate (legitimate) expectations.
