REFORMING THE UKRAINIAN LEGISLATIVE SYSTEM IN THE CONTEXT OF EUROPEAN INTEGRATION: CURRENT REALITIES AND CHALLENGES
The article examines the general and most significant challenges of reforming the Ukrainian legislative system in the context of European integration. It is noted that the implementation of Ukraine's European integration aspirations after the signing of the Association Agreement with the EU revealed many problems and inconsistencies in their practical implementation, in particular of an institutional, personnel, and regulatory nature, which require a certain rethinking of the regulatory principles of the development of modern states, its institutional structures, as well as the cultural codes of society, which are not limited exclusively to the legal component.
The position is substantiated that ensuring proper legal harmonization between the norms of Ukrainian legislation and EU law requires the development of such approaches and methods of forming legal structures that will take into account the influence of moral and religious factors on social relations, as well as on the legislative process and law enforcement practice. The problem of the high level of dynamics of the development of Ukrainian legislation in the context of European integration is also emphasized, which often becomes an objective obstacle to properly ensuring the principle of its stability and predictability, and therefore is a serious problem for the effectiveness of legal regulation. A separate angle of the article is devoted to the problem of the collision of legal traditions, cultures and, accordingly, legal consciousness, which are due to the specifics of the historical development of European states, the influence of certain socio-cultural factors on legal development, etc.
It is concluded that the key basis for the convergence of the legal systems of Ukraine and the EU should also be the need to preserve the national cultural code of our society, which has always functioned within the framework of stable correlation of law and other socionormative systems, interdependencies and relationships between them.
