Reinforcement of the principle of equality of parties when courts consider documents in administrative and civil proceedings
Abstract
The article analyzes the principle of equality of all participants in the trial before the law and the court, statements from the official legislation of Ukraine, international treaties ratified by the Verkhovna Rada of Ukraine, decisions of the European Court of Human Rights, judicial practice and the work of scientists.
The author concludes that the equality of all participants in the legal process before the law and the court is one of the European values in the field of protection of human rights and freedoms.
The goal is revealed: the realization by the party in the case of the right to a fair judicial decision by ensuring that the legislator and the courts observe the principle of equality of all participants in the process before the law and the court.
Proposals are provided for solving problems related to observing the principle of equality of the parties to the trial before the law and the court, by introducing the legislator's relevant additions to the legal norms of the procedural legislation of Ukraine. The indicated amendments to the legislation will contribute to compliance with the requirements of the "quality" of the law, which the European Court of Human Rights insists on in its decisions.
