Application of statute of limitation in appeal review of cases
Abstract
The article examines the possibilities and conditions for applying the statute of limitations in appellate review of cases. In general, the statute of limitations is applied by the court only upon the application of a party to the dispute made before it rendered its decision, therefore the appellate court does not have the right to consider an application for the application of the statute of limitations, since this will be a consideration outside the scope of the decision of the court of first instance. This rule was supported by the Supreme Court of Ukraine until the Resolution of the Grand Chamber of the Supreme Court of 17.04.2018 in case No. 200/11343/14-ts made a decision to deviate from this position. It is substantiated that the defendant, who was not properly (in accordance with the requirements of procedural law) notified of the time and place of the hearing of the case in the court of first instance, does not have equal opportunities with the plaintiff to present evidence, examine it and prove its persuasiveness before this court, and cannot prove on an equal footing with the plaintiff in the court of first instance the circumstances to which he refers as the basis for his objections. It is ruled that the fact that the defendant, who was not properly notified by the court of first instance of the time and place of the hearing of the case, did not participate in such hearing is a basis for the appellate court to resolve this defendant's application for the application of the limitation period, even if such an application was not filed by him in the court of first instance. At the same time, the appellate court has the right to accept for consideration an application for the application of the limitation period only on condition that the defendant in the case was not properly notified by the court of first instance about the day and time of the trial, or in the case of other good reasons that objectively deprived the person of making such an application in the court of first instance, as a result of which the principle of procedural equality of the parties was violated.
