Algorithm of Actions in Case of a Person Missing Under Special Circumstances: Problematic Issues

 

Abstract 

The article examines the problematic aspects of the algorithm of actions in the event of a person going missing under special circumstances. It highlights that most structures related to the military sphere provide information on their official websites that interprets the same issues differently, leading to confusion among the next of kin and family members of the missing servicemember.

The study substantiates the necessity to legally obligate employees of the Territorial Recruitment and Social Support Centers (TRSSCs) to provide clarifications and consultations to the next of kin and family members of persons missing under special circumstances. It is proposed to supplement the «Algorithm of Actions in Case of a Disappearance Under Special Circumstances» with a step for next of kin and family members to seek Free Legal Aid. Notably, as of June 5, 2025, the Law of Ukraine «On the Legal Status of Persons Missing Under Special Circumstances» already guarantees the right to free legal aid in accordance with the Law of Ukraine «On Free Legal Aid» (Part 6, Article 6). Furthermore, it is essential to ensure full digitalization and integration of all available resources regarding the search for persons missing under special circumstances.
