МЕТА І ПРИНЦИПИ ІНСТИТУТУ ВРЕГУЛЮВАННЯ ЦИВІЛЬНОГО СПОРУ ЗА УЧАСТЮ СУДДІ

Стаття присвячена з’ясуванню мети і принципів інституту врегулювання цивільного спору за участю судді як самостійного процесуально-го інституту. Розкрита мета інституту врегулювання цивільного спору за участю судді у широкому розумінні – мирне врегулювання цивільного спору (охоронюваного правовідношення) за участю судді як уповноваженого суб’єкта ведення процедури. У буквальному розумінні мета полягає у зближенні позицій сторін у цивільній справі з урахуванням їх інтересів. Доведено, що основоположним принципом врегулювання цивільного спору за участю судді є принцип добровільності, а до процедурних належать: принцип конфіденційності, рівності сторін, співробітництва та самостійності сторін саме в динаміці процесу.
