ЩОДО ВИПАДКІВ ЗАТРИМАННЯ ОСОБИ, ПІДОЗРЮВАНОЇ У ВЧИНЕННІ ЗЛОЧИНУ УПОВНОВАЖЕНОЮ СЛУЖБОВОЮ ОСОБОЮ

У статті аналізуються випадки затримання особи, передбачені ст. 208 Кримінального процесуального кодексу України. Зроблено висновок, що зазначена стаття потребує вдосконалення. Визначено підстави для оскарження законності затримання особи в порядку цієї статті та проміжки часу, які відповідно до судової практики вважаються незаконними.

Ключові слова: затримання, підстави для затримання, позбавлення свободи, захист від свавілля.
