ДОКТРИНА «НІЖНОГО ВІКУ ДИТИНИ» ТА ДОКТРИНА «НАЙКРАЩИХ ІНТЕРЕСІВ ДИТИНИ» В СВІТЛІ НАЦІОНАЛЬНОЇ СУДОВОЇ ПРАКТИКИ
У статті аналізуються підходи до встановлення опіки та визначення місця проживання дитини, які виникли в країнах загального права та отримали загальносвітове визнання, а також досліджується їх відображення в міжнародних актах і національному законодавстві. Висвітлюються тенденції судової практики щодо визначення місця проживання дитини.
Ключові слова: опіка, місце проживання дитини, найкращі інтереси дитини, презумпція.
