ОСОБЛИВОСТІ ВІДСТОРОНЕННЯ ВІД ПОСАДИ ОСІБ, ЯКІ ПРИЗНАЧАЮТЬСЯ ПРЕЗИДЕНТОМ УКРАЇНИ

У статті автор розглядає питання відсторонення від посади в кримінальному судочинстві України, як захід кримінально-процесуального примусу.

Розглянуто питання, чи можна покладати на Президента України таку функцію, яка у кримінальному провадженні є судовою? Чи є така процедура у разі реалізації Президентом України своїх повноважень?

Також у статті аналізуються низка критеріїв запропонованих ЄСПЛ, на основі яких визначається, чи виконує той чи інший орган судову функцію.

Ключові слова: відсторонення від посади, кримінальне судочинство, кримінально-процесуальний примус.
