ДІЯ ПРИНЦИПУ ПРОПОРЦІЙНОСТІ ПІД ЧАС УХВАЛЕННЯ
РІШЕННЯ ЩОДО ЗВІЛЬНЕННЯ СУДДІ З ПОСАДИ
У статті йдеться про порушення, які найчастіше є підставами для притягнення суддів до дисциплінарної відповідальності та застосування до них найсуворішого стягнення, а саме подання про звільнення судді з посади. Аналізується практика застосування дисциплінарними органами принципу пропорційності стягнення вчиненому правопорушенню та її неоднозначність.
Ключові слова:дисциплінарна відповідальність судді, принцип пропорційності, дисциплінарний проступок, стягнення, звільнення судді з посади.
