СПРАВИ ПРО ВИЗНАЧЕННЯ МІСЦЯ ПРОЖИВАННЯ З МЕТОЮ

ЗАБЕЗПЕЧЕННЯ ЇЇ НАЙКРАЩИХ ІНТЕРЕСІВ

У статті аналізується співвідношення цивільного і податкового законодавства на прикладі спадкового правонаступництва в податкових правовідносинах. Досліджується судова практика вирішення спорів про стягнення податкового боргу у випадках настання смерті відповідача, процесуальні дії суду. У статті досліджено питання застосування норм цивільного законодавства до відносин, які виникли до набрання ними чинності.

Аналізуються питання формування судової практики та впливу Верховного Суду на застосування судами законодавства про спадкування.

Ключові слова: спадкування, спадкоємці, податкові відносини, спадкове право.
