ПРОЦЕСУАЛЬНА АНАЛОГІЯ: САМОСТІЙНИЙ ПРИНЦИП

КРИМІНАЛЬНОГО ПРОВАДЖЕННЯ ЧИ ЕЛЕМЕНТ ЗАКОННОСТІ

Стаття присвячена дослідженню місця процесуальної аналогії в системі принципів кримінального провадження з огляду на законодавчо закріплені положення у частині шостій ст. 9 КПК України. Обґрунтовано використання терміна «процесуальна аналогія» як найбільш коректного та такого, що охоплює поняття «аналогія закону» та «аналогія права», оскільки, незважаючи на законодавчу конструкцію, доктринальні положення та судова практика констатують допустимість обох видів аналогії у вітчизняному кримінальному процесі. Зроблено висновок, що процесуальна аналогія не є самостійним принципом кримінального провадження, а є способом реалізації законності.
