ІНСТИТУЦІЙНІ ГАРАНТІЇ НЕЗАЛЕЖНОСТІ СУДОВОЇ ВЛАДИ ТА ЦІЛІСНІСТЬ (INTEGRITY) СУДДІВ

Судова влада володіє внутрішніми резервами для забезпечення власної незалежності, відіграючи провідну роль у гарантуванні поділу влади та захисті людських прав. У статті розкрито інституційні гарантій незалежності судової влади та цілісності суддів, роль судів у забезпеченні засад конституційної держави, зокрема в умовах воєнного стану і перспектив розвитку інституту військової юстиції. Визначено основні аспекти інституційної спроможності судової влади через аналіз сильних і слабких сторін, можливості та потенційні загрози ефективного правосуддя (SWOT-аналіз).

Ключові слова: відповідальність суддів, конституційна демократія, людські права, незалежність судів, поділ влади, цілісність суддів.
