DETERMINING THE FORM OF COMPLICITY WHEN CLASSIFYING WAR CRIMES: BASIC APPROACHES IN JUDICIAL PRACTICE (based on the example of the “Yagidnyansky case”)

 

The article examines the problem of approaches in judicial practice to determining the form of complicity during the qualification of war crimes (Article 438 of the Criminal Code of Ukraine). It concludes that there is no uniformity in judicial practice in terms of determining the form of complicity when conducting a separate assessment of the actions of defendants accused of committing war crimes. The approach that such a separate criminal law assessment is not capable of ensuring the completeness of the classification is supported. It is proposed to carry out such a classification taking into account the commission of war crimes by individual servicemen of the armed forces of the Russian Federation within the framework of the criminal activities of a criminal organization.
